The civil procedure code gives an opportunity for aggrieved persons affected by vexations and meritless original suits filed against them in order to harass them which are to be nipped at the bud and rejected at threshold.
Order VII, Rule 11 of Civil Procedure Code enumerates grounds for rejection of plaint and if you find that any suit is filed without any merits against you, you may approach the Hon’ble Court of law with the above application to reject such a plaint with proper grounds in accordance with law. By the above method you can avoid tedious trial proceedings and wastage of time.
However, the above application will be ordered to be allowed only if there are proper grounds for the Court to do so and only if the suit is frivilous or barred by any law or is undervalued or if attracts any of the provisions in order VII, Rule 11 of Civil Procedure Code your application may be allowed and you would also save time and money in running behind such frivilous suits.
